GENERAL TERMS AND CONDITIONS
By booking with Tu Finca Balear S.L.and its website www.tu-finca-mallorca.com (hereinafter TFM), the client accepts the "Booking Conditions" described below:
- Contract and booking procedure
When you make a reservation, you warrant that you have legal capacity and that you are acting on your own behalf. Your contract with Tu Finca Balear SL is valid at the time of acceptance of the booking by TFM as agent of their booking offer.
The client offers bindingly to the landlord represented by TFM the conclusion of a rental contract for a private holiday property. Bookings are made in writing by e-mail, through third-party providers (booking portals) or by reservation on the website www.tu-finca-mallorca.com.
The rental contract is concluded by sending the booking confirmation and receiving the deposit, which TFM issues and manages as an intermediary on behalf of the owner. The contract is subject to Spanish law and exclusively to the jurisdiction of the registered office of Tu Finca Balear SL.
- Prices and offers
The respective booking prices always apply to the prices displayed on the website at the time of booking.
TFM reserves the right to publish last minute offers without prior notice and at its discretion. Consequently, the customer cannot claim any discounts or price reductions after booking confirmation.
The Tourist Ecotax must be paid by each guest on a compulsory basis, per day and per person over 16 years of age. Prices and information can be found here >>Tourist Tax<<
- Liability
Descriptions, photos and other information on TFM correspond to the information given on the website at the time of publication of the property. Similarly, TFM undertakes to update this information at its discretion, which means that photographs and other information may be changed at any time. TFM accepts no liability for any changes in furniture or fittings that may occur after the booking has been confirmed and before the client enters the property.
TFM accepts no liability for possible disruption in cases of force majeure, such as strikes, war, pandemics, earthquakes, disruption of electricity and water supplies, severe weather, nearby construction sites and other conditions which could not have been foreseen at the time of booking.
TFM also accepts no liability for malfunction of electrical appliances, heating, air conditioning, pool, internet, etc. Although TFM regularly checks the condition of the domestic appliances in each property, this ultimately depends on the owner. If a malfunction is detected by the client, this must be reported to TFM in writing without delay so that it can be rectified by the owner as soon as possible. Please take into account that the rectification of a malfunction may take some time. Therefore, TFM does not assume any liability and costs for possible complaints in case of malfunctions that could occur after leaving the property. The client is responsible for the proper use of the property and its contents, both indoors (electrical appliances, furniture, etc.) and outdoors (pool, barbecue, etc.). TFM accepts no responsibility for any accidents that may occur during the stay, nor for any robbery or theft of any items inside or outside the booked property. All complaints must be made immediately in writing to the owner and/or TFM. Complaints submitted after the stay will not be accepted.
- Damages
The client agrees to use the property and all equipment properly. Should any damage occur, the client shall contact the owner or TFM within 24 hours to repair it. If the damage is found to have been caused by the client, a reasonable compensation payment may be claimed.
- Changes and termination of contract by TFM
TFM may terminate the booking contract immediately if:
a) ...damage is caused by improper use on the part of the client or his accompanying persons.
b) ...noise or other disturbance is caused to neighbours or persons in the vicinity.
c) ...the owner's own rules regarding the times of use of the pool, use of the air conditioning, party and smoking ban etc. are not observed.
d) ...the balance of the booking has not been paid at the time of handing over the keys or the deposit, service charges and taxes, if applicable, have not been paid.
e) ... Over-occupancy of the house or bringing pets without prior arrangement.
In these cases, any payment already made will not be refunded.
- Cancellation conditions
The following General Cancellation Charges apply unless separate terms and conditions apply at the time of booking: These will be shown to you at the time of booking on www.tu-finca-mallorca.com.
in the event of cancellation up to 60 days before the start of the holiday: the deposit (20% of the rental price),
in the event of cancellation from the 60th day up to the 3rd day before the start of the trip: 90% of the rental price.
in case of cancellation less than 3 days or no-show: 100% of the rental price. We recommend that you take out travel cancellation insurance.
- Arrival
The number of persons and animals stated at the time of booking shall be adhered to by the customer.
You will receive the arrival and contact information by email after receipt of the final payment, as well as the complete completion of the police registration documents.
- Departure
The maximum departure time is before 10 am. The house will be handed over to the responsible person on departure swept clean, dishes washed and put away, and all rubbish disposed of. In case of non-compliance, an additional fee may be charged for the extra cleaning work. Should the arrival of the next guest be delayed or prevented, this will be charged to the departing guest.
- Data protection clause
In accordance with the provisions of Organic Law 15/1999, we inform you that your data will be stored in an automated file under the responsibility of TU FINCA BALEAR SL, in order to fulfil the obligations arising from the business relationship we have with you. You may exercise your rights of access, cancellation, rectification and opposition at any time by writing to our address: C./ Gran 27-1º, 07420 Sa Pobla (Illes Balears). Unless you notify us to the contrary within a period of 30 days, your data will be considered unchanged by us. You undertake to notify us of any change and we have your consent for the use of your personal data to maintain our relationship.
